Resumen
The public sector hiring system in Peru shows marked heterogeneity, highlighting the Administrative Services Contract (CAS) and Legislative Decree 728 regimes. This duality has sparked debates about the existence of wage inequality and the violation of fundamental labor rights. This study aims to comparatively analyze the differences in remuneration, benefits, and job stability between both regimes, and their impact on the principle of equality and non-discrimination. Through a systematic literature review, regulations, Constitutional Tribunal jurisprudence, and relevant academic production were examined. The findings reveal significant gaps in compensation and social benefits to the detriment of CAS workers, despite performing functions similar to their D.L. 728 counterparts. It is concluded that this structural differentiation not only contravenes the principle of “equal pay for equal work” but also affects the organizational climate and the quality of public services. Moving towards a unification of regimes that guarantees equity is recommended.
