The third dimension of criminal procedure reform: An analysis of the social, political and legal context in Perú

Guzmán Ruiz de Castilla N. · Revista Brasileira de Direito Processual Penal (2026) · DOI: 10.22197/rbdpp.v12i2.1443

Resumen

In recent years, numerous conferences, seminars, and academic projects have been developed around procedural reform. However, the results have mostly been unsatisfactory. This is primarily due to the fact that the commissions in charge of the reform have focused almost exclusively on the redesign of legal institutions, while demoting the analysis of the actual functioning of the justice system and its interaction with the broader social framework. In this context, the present article intends to examine the social dichotomy as a third dimension of procedural reform; in order to demonstrate how social, cultural and institutional factors decisively influence the effectiveness and legitimacy of the Peruvian justice system.
