The Principle of Presumption of Veracity: Background and Current Scope
Vásquez P.R. · Revista de Derecho Administrativo Economico (2025) · DOI: 10.7764/redae.42.7
Resumen
This article analyzes the principle of presumption of veracity as recognized in Law No. 27444, the Peruvian General Administrative Procedure Act. First, it examines how this principle streamlines administrative procedures by assuming, unless proven otherwise, that the documentation submitted by citizens is authentic. It then describes both the historical background of the principle and the provisions governing its current application. Furthermore, it explains how the presumption of veracity is complemented by the principle of subsequent controls, which empowers the Administration to verify the authenticity of such documentation once the procedure has concluded. This analysis offers important lessons that may be of particular relevance to other legal systems in the region.
