Resumen
The research aims to establish a doctrinal discussion on the crime of robbery and theft in contrast to the casuistry reviewed in a prosecutor’s office in the Peruvian Amazon. To this end, from a qualitative approach, based on a case study, a basic type of research was applied which shows that without peripheral elements of objective conviction to support the veracity of the facts and without the collection of substitute evidence, justice operators are left without the possibility of even formalizing the preliminary investigation, so that the crimes of robbery and theft generally go unpunished. This poses a series of challenges in the face of a widespread and normalized problem in which crime and delinquency seem unstoppable.
