Resumen
In Peru, it is very common to see a lack of attention to the regulations and public policies applicable after the criminal process in corruption cases, particularly regarding civil reparations. Therefore, this research aims to analyze how the collection of civil reparations in corruption crimes is more of an economic problem than a criminal-legal one. To achieve this, a descriptive-level methodology with a mixed approach was employed, divided into two stages: a theoretical analysis with a qualitative, analytical-rational approach, and an empirical analysis with a quantitative, descriptive, and cross-sectional approach, using a study population of 4,721 corruption cases with final judgments between 2001 and 2020. The main finding revealed that the level of enforcement for collecting civil reparations in corruption cases was minimal. Additionally, a possible relationship between GDP growth and the payment of civil reparations is suggested.
