Resumen
Macroalgae are aquatic organisms that provide ecosystem services, and they are used in a variety of industries. The second-largest producer of macroalgae in the Americas is Peru; however, there has been no critical summary of the legislation pertaining to this resource since the foundations for its creation were laid down more than 20 years ago. The aim of this study was to compile, systematize and thematically analyze the legislation and regulations associated with macroalgae resources in Peru, up to and including 2022, in order to facilitate access to updated information on legislation and provide recommendations applicable to the production management of macroalgae. A total of 71 documents were obtained, of which 10 were Supreme Decrees, 52 Ministerial Resolutions and 9 Regional Ordinances. Among the topics addressed, legal aspects in relation to licensing and authorization were prevalent. Most of the regulatory documents dealt with issues related to brown algae (Phaeophyceae). Historically, regulations issued at the regional level focused primarily on Ica and Arequipa. With regard to the issue of processing plants, this activity was classified as industrial and adaptation deadlines were established in order to ensure that artisanal plants comply with the established technical requirements. Social conflicts, the participation of opportunistic actors, the absence of the formulation of regulations for "emerging" sectors, as well as information gaps in technological, application and taxonomic research, were identified as challenges for the development of a regulatory framework. In addition, other critical issues were identified that will require greater attention and reinforcement in the future, given the predicted growth and expansion of the industry. © Los autores, 2024.
