Resumen
School dropout in public educational institutions in the province of San Martín constitutes a violation of the fundamental right to education, particularly in rural contexts marked by poverty, inequality, and state deficiencies. This study aimed to analyze, from a legal perspective, how the structural causes of school abandonment affect the exercise of fundamental rights. A basic methodology was applied, using a qualitative approach and grounded theory design, with document analysis and interviews conducted with experts from the public education sector. The results identified the main dropout factors as economic hardship, lack of adequate infrastructure, and the absence of institutional support. Furthermore, it was evidenced that dropout negatively impacts social cohesion, community development, and limits the exercise of other fundamental rights. In conclusion, the research demonstrated that the State incurs legal omissions by failing to guarantee the minimum conditions for school permanence, thereby breaching both constitutional and international obligations. School dropout must be addressed as a structural issue that requires comprehensive public policies grounded in a human rights approach.
