Research methodology in Law and Literature for legal and human rights education

Avellaneda-Vásquez J. · Justicia (Barranquilla) (2024) · DOI: 10.17081/just.29.45.7342

Resumen

The objective of this article was to design an interdisciplinary methodology for research in Law and Literature, specifically, how literature can enhance the teaching-learning of law and promote justice and respect for human rights. The methodology used was qualitative interdisciplinary documentary analysis, with a hermeneutic method and an exploratory-descriptive scope. The results offered a methodological guide that weights the hermeneutic and critical paradigm, the qualitative approach, the exploratory scope, the legal sociological, legal comparative, hermeneutic and case study methods, etc. The case study was highlighted by assuming literary works as cases, subject to a theoretical analysis and a socio-contextual corroboration. In addition, from the perspective of Law in literature, literature was highlighted, on the one hand, as an effective didactic resource for the teaching of law, useful to promote the adoption of a critical, constructive, pragmatic legal awareness in students; on the other hand, as a mechanism for the protection of human rights, seeking that human rights violations be known and never forgotten. In conclusion, research in Law and Literature is essential, and a methodological proposal gives it a scientific character, providing a broader, more humane and accessible understanding of law.
