Mining and environmental regulation

Resumen
Regulation of the mining industry has undergone changes in recent decades, depending on the buoyancy of mineral prices and the relative strength of the actors involved. For its part, the state has lacked the autonomy to drive its own agenda. At the local level, there is widespread skepticism about the distance between official language and policy application. The evolution of regulation has varied according to the strength of external influences and to the degree of effective democracy enabling pressures emanating from civil society to make themselves felt. In recent years, with democracy in decline, the mining sector itself is viewed as exerting disproportionate influence and achieving regulatory rollback, amid a narrative of excessive ‘red tape’ and the unnecessary barriers to growth.
