Resumen
Traditionally, every legal text is assumed to be objective and neutral, but linguistic studies have shown that the enunciator of the discourse leaves traces of his or her voice in a text that is neither monologic nor neutral (García, 2008). Taking into account that the judgment of cassation is a legal document that the Supreme Court of Justice issues to evaluate the request to abrogate a previous judicial sentence, the objective of our research has been to describe the superstructure and microstructure of the discursive genre casación (cassation), as well as to determine if there is subjectivity in any of the texts analyzed based on how the agent is presented and other linguistic phenomena. We have used the qualitative method to analyze four cassations under the systemic-functional linguistics (SFL) approach. The findings show that the length of the summary, the unequal treatment of the agent (sometimes impersonal or referred to by metonymy, sometimes explicit and emphasized) and the use of adjectives such as presunto (presumed) and supuesto (supposed) are evidence of subjectivity in one of the texts.
