(Legal vacuum and violation of rights in assisted reproduction techniques in Peru)

Paredes C.A.R.; Roque D.M.D. · Sortuz (2026) · DOI: 10.35295/sz.iisl.2326

Resumen

The study analyzes the contradictions arising from the legal void in Assisted Reproductive Techniques (ART) such as in vitro fertilization (IVF), in its two forms, conventional and intracytoplasmic sperm injection (ICSI), and its relationship with the transgression of fundamental rights, such as the right to reproductive health and the right to establish a family. The mixed methodology included a dogmatic-legal analysis of the current regulations, as well as the application of surveys to 100 lawyers, 50 health professionals, and 25 candidates for ART, who were also interviewed. The Spearman coefficient revealed positive correlations among lawyers (rho= 0.688) and health professionals, as well as a very high relationship among candidates for ART (rho= 0.893). With 99% confidence, it is concluded that the legal void in ART such as IVF (both conventional and ICSI) impacts the transgression of the analyzed fundamental rights.
