Resumen
This article analyzes the use and effects of the interpretative laws of the Constitution in Peru. It considers their contradictory relationship with the principle of constitutional rigidity and the democratic regime itself. Based on the study of specific cases and the limits set by constitutional jurisprudence, it argues that laws that seek to interpret the Constitution are, in practice, disguised constitutional reforms, which constitute an intolerable fraud to the Constitution. It also analyzes how detrimental it is, in this scenario, not to have an impartial constitutional jurisdiction that performs an effective control of the constitutionality of the laws; specifying the need to reform the system of election of constitutional magistrates in attention to a suitable profile.
