Resumen
This article analyses the recognition and protection of the right to strike at the international level, with special emphasis on the debate within the ILO regarding its —implicit— recognition in Convention 87. It examines the divergent positions of the Employers’ and Workers’ groups, the interpretation of the ILO supervisory bodies, and the development of jurisprudence within the Inter- American Human Rights System, with special attention to Advisory Opinion OC-27/21 of the Inter- American Court of Human Rights. This text highlights the importance of the implicit and explicit recognition of the right to strike, its character as a fundamental human right, and the interdependence between freedom of association and the right to strike as a current challenge for its effective protection in international law.
