Indivisibility as systemic coherence: a response to factual separability and the individualistic erosion of human rights

Rimachi A.M. · Cuadernos Electronicos de Filosofia del Derecho (2026) · DOI: 10.7203/cefd.55.32102

Resumen

The principle of the indivisibility of human rights faces a double threat: external critique of de facto separability and internal erosion by an autonomous individualism that precipitates the “overflow” of rights such as reproductive autonomy, fracturing their constitutive connection with other rights such as mental health. This paper posits indivisibility not as an empirical hypothesis, but as a hermeneutic and regulatory principle anchored in the essential core of rights. This model recontextualizes the critique of separability by limiting it to the gradual periphery and establishes itself as a normative barrier against individualistic overflow, becoming an indispensable tool for systemic coherence. © (2026), (University of Valencia, Human Rights Institute.).
