Inclusive public policies in the Peruvian penal system as an alternative to preventive detention in women

Floriano Rodríguez R.; Contreras Horna R.F.; Contreras Horna A.M.; Floriano Mija G.M. · Revista Venezolana de Gerencia (2024) · DOI: 10.52080/rvgluz.29.e11.17

Resumen

In Peru, concrete measures have not yet been implemented to guarantee the rights of pregnant women and women with children in the penal system, and it is essential to carry out a study to evaluate the current situation and propose specific actions that can be incorporated into public policies. Therefore, this research aimed to analyze preventive detention and alternative measures for pregnant women and women with children under three years of age, developing a basic type study, with a qualitative and hermeneutical approach of descriptive scope based on grounded theory, where an interview was applied to the sample made up of 12 professionals linked to the judicial process. The results showed that the preventive prisons applied violate the criminal and procedural rights and guarantees of women, having a negative impact on their health and well-being. It was concluded that in Peru, policies that adequately protect pregnant women and women with young children in the penal system are not being applied well because, although there are alternative options to preventive detention, these are not widely used due to the lack of judicial training and the preference for more punitive approaches.
