Free prior and informed consent among indigenous communities

Merino R. · Mining and the Peruvian State: Social and Environmental Sustainability (2026) · DOI: 10.4324/9781003746867-10

Resumen

Free, prior and informed consent is a key mechanism for negotiation between indigenous communities and extractive companies operating in lands to which the former have title. However, the chapter shows how free, prior and informed consent varies between indigenous communities negotiating with mining companies in the Andean highlands and those dealing with extractive activities (primarily oil) in the Amazon lowlands. Highland communities are notably less attuned to seeking the benefits of free, prior and informed consent than their lowland counterparts, reflecting a lower degree of internal community organization and a lack of access to support from indigenous federations to be found in the Amazon. Highland communities show less interest in negotiation and more accepting of proposals for mining.
