Financial identity as a fundamental right: Strengthening financial inclusion and advancing economic rights in Peru

Rodríguez Cairo V.; Chávarri Balladares A.F.; Flores Reategui L.E. · Estudios Constitucionales (2026) · DOI: 10.4067/s0718-52002026000100131

Resumen

The study analyzes the constitutional feasibility of recognizing financial identity as a fundamental right in Peru. From a qualitative approach, based on documentary review and triangulation of constitutional-dogmatic, doctrinal, and empirical-contextual sources, it is argued that its express enshrinement would strengthen the financial inclusion of vulnerable populations and promote the effective exercise of economic rights. It concludes that its constitutionalization would not only establish binding regulatory parameters for state action, but would also generate enforceable duties of guarantee, regulation, and supervision aimed at eliminating structural barriers, preventing discrimination, and ensuring an inclusive regulatory environment in financial markets.
