Fight against corruption and the implementation of judicial reforms. Theoretical contribution to strengthening the rule of law

Saavedra-Neyra M.; Huaccha-Villavicencio M.L. · Clio. Revista de Historia, Ciencias Humanas y Pensamiento Critico. (2024) · DOI: 10.5281/zenodo.12600692

Resumen

Corruption is a sociopolitical and economic phenomenon with a cultural and ethical burden that seems to be unavoidable, at least in Latin American countries. It is present in various public and private spheres, it frequently mutates, it is hidden, it transforms, it drifts, it is rapidly recurring, therefore, it represents a threat to the Rule of Law. Therefore, this study based on qualitative-documentary methodology of hermeneutic assessment, seeks to reflect on the fight to combat corruption by providing theoretical constructs that serve as a reference for judicial reforms that contribute to minimizing the occurrence of the phenomenon. Causal relationships are established for the perceived and real weakening of the Rule of Law, when the recurrence of corruption represents a high risk for society. The approach in the field of diasdoralogy is reflected from a holistic vision to implement judicial reforms as a theoretical contribution to minimize corruption crimes.
