Resumen
This article aimed to analyze the doctrinal positions surrounding surrogacy by critically examining the arguments that support its recognition as a legitimate form of reproductive autonomy versus those that frame it as a manifestation of commodification of the female body. A systematic literature review was conducted using the PRISMA methodology, including 37 academic articles published between 2017 and 2025 in the Web of Science, Scopus and Scielo databases. The study addressed doctrinal approaches from the perspectives of bioethics, comparative law, legal philosophy, and feminist theory, also considering the regulatory implications in various legal systems. It concludes that surrogacy is a practice fraught with legal tensions and ethical dilemmas that challenge traditional normative frameworks, requiring specific normative regulation under interdisciplinary approaches that balance reproductive autonomy with the protection of human dignity.
