Resumen
This article analyzes the applicability of the employment test in the legal classification of the relationship between delivery drivers and digital platforms in Ni-caragua. Using a qualitative methodology with an analytical-synthetic, abstract-con-crete, and hypothetical-deductive approach, and through the documentary analysis of doctrinal, normative, and jurisprudential sources, the elements that make up the traditional employment relationship and their relevance to new forms of technology-mediated work are examined. The study finds that the employment test is useful for determining the legal nature of ambiguous employment relationships in the digital environment. It concludes that its implementation would contribute to strengthening legal certainty and the effectiveness of labor rights. However, there is limited jurisprudential acceptance of the test in Nicaragua, which restricts its practical scope. The original value of the study lies in adapting a classic tool of labor law to a contemporary scenario, proposing a critical reading of the current legal framework and offering theoretical inputs for its eventual reform. © (2026), (Universidad Nacional Autonoma de Mexico, Instituto de Astronomia).
