CRIMINAL CONDUCT AND ETHICAL RELATIVISM IN THE PERIPHERAL INDOAMERICAN COUNTRIES
Patio G.R. · Revista Notas Historicas y Geograficas (2022)
Resumen
The author analyzes the problem of the causes of criminality in the peripheral indo-american countries whose determination is the purpose of Criminology, examining the causal relationship that exists between ethical relativism and criminal behavior, observing that, according to that current of thought, ethics is individual and autonomous, so that the heteronomous demand manifested through informal and formal social control determines personal behavior less and less, evidencing a greater amount of personal freedom, although not necessarily individual responsibility and, correlatively, less state decisionism, since criminal regulations no longer deter or counter-motivate unwanted and non-conforming conduct, having become a merely allegorical criminal law.
