Consumer Rights in Peruvian Territory: An Analysis of Law No. 29571 Consumer Protection and Defense Code

Ballona-Castro E.R.; Herrera-Mena T.K. · Clio. Revista de Historia, Ciencias Humanas y Pensamiento Critico. (2025) · DOI: 10.5281/zenodo.14566990

Resumen

The dilemma lies in the fact that consumers lack sufficient information about the impact that Genetically Modified Organisms (GMOs) can have on their health. There is no information about whether these organisms are safe or harmful to health, whether they negatively impact the environment or whether they cause other side effects. Having this information is crucial in order for consumers to be able to make informed and conscious decisions about whether or not to buy products that contain GMOs or derivatives thereof. However, there is currently no warning on products or foods about whether they contain GMOs. Moreover, although the regulation that protects and defends consumers as users, buyers, and clients mentions in its Section 37 the obligation to label certain products with information about their composition, this regulation only applies to products containing genetically modified elements, not to genetically modified products themselves. There is no regulatory framework defining specific requirements for labeling or the data that labels should contain. As a result, there are no labeled products in the Peruvian market indicating whether they are genetically modified or contain genetically modified components. These deficiencies directly affect the protection of fundamental rights to information and health.
