Resumen
The food services market in Peru grew by 4.22% by December 2025, showing the progress in the sale of food and beverages, highlighting the importance of protecting the consumer against risks derived from food consumption. The objective is to analyze the effectiveness of the Peruvian legal framework in the protection of consumers against risks derived from the sale of food in food establishments. It adopts a qualitative approach at a descriptive level, and with a hermeneutical technique. The result showed that strengthening inspection and administrative procedures is key to ensuring compliance with quality, safety and adequate information standards in food establishments. It was concluded that it is necessary to promote a regulatory approach that prioritizes the prevention of harm and consumer protection, so that the right to the consumption of safe food is consolidated as a real guarantee within the gastronomic services market.
