COMMERCIAL OPERATIONS UNDER THE SPANISH LAW FOR THE FIGHT AGAINST DELAYS THAT CONFIGURE INTERNATIONAL SALE OF GOODS IN THE VIENNA CONVENTION: QUID IURIS?
Herrada Bazán V. · Actualidad Juridica Iberoamericana (2022)
Resumen
This paper analyzes the scope of the Late Payments in Commercial Transactions Spanish Law (Ley 3/2004) and that of the Convention on the International Sales of Goods (CISG). Once this scope has been delimited, the author seeks to resolve the question about what regulation is applicable to an international sale of goods that qualifies as a “commercial transaction” between parties located in Spain and in another country of the European Union: is it the CISG, provided that said other country is it part of the Convention, or is it the aforementioned Spanish Law –when the rules of private international law lead to the application of the Spanish legal system–, since it implies the transposition of a European Directive?.
