ASSISTED REPRODUCTIVE TECHNOLOGIES AND THEIR DELINKING FROM THE RIGHT TO REPRODUCTIVE HEALTH AND AUTONOMY

Resumen
The purpose of this article is to provide sufficient justification for the objection to the current thesis that postulates assisted reproductive techniques (ART) as part of reproductive rights. It will be disputed that the prohibition of ART represents a violation of the right to reproductive health and autonomy; that the right to freely access ART derives from the right to found a family; and that the so-called “rights” to a child or to assisted reproduction for social reasons are part of reproductive rights. This work will address these issues in the context of infertile couples. A renewed feminine perspective is offered that recognizes the vindication of women’s rights, of motherhood and paternity, and paves the way to a new debate about reproductive rights within the framework of the continuous rethinking of human rights.
