Advances and challenges in access to justice for children and adolescents in the Peruvian Amazon

rodríguez-Sotelo E. · Juridicas (2024) · DOI: 10.17151/jurid.2024.21.2.3

Resumen

The article analyzes progress and challenges in access to justice for children and adolescents in the Peruvian Amazon, considering the importance of this right in their development and well-being in situations that compromise their normal development in society. A qualitative approach, basic type and hermeneutic theory design was applied through which an analysis and interpretation of each bibliographic work used in this study was carried out. The participation of children and adolescents in various processes such as nourishment, shared custody, visitation, abandonment, among others, should be guided by the principle of best interests without violating their rights. However, it is more difficult for children and adolescents within the Amazon region to access justice institutions because there are still deficient barriers within the Peruvian system, resulting in limited access to the legal system for this population. It is imperative that judicial systems and States adopt proactive measures to eliminate these barriers, ensuring that all individuals, regardless of their origin, economic status or geographic location, can exercise their legal rights effectively and equitably. © (2024), (Universidad de Caldas).
