Accessibility and Digital Governance: Compliance with Inclusive Standards in the Governmental Platforms of the Peruvian State

Seminario-Hurtado N.; Cuadrao V.A.B. · Estudios en Derecho a la Informacion (2026) · DOI: 10.22201/iij.25940082e.2026.21.20279

Resumen

The present article aims to analyze the compliance with Peruvian regulations and Web Content Accessibility Guidelines (WCAG) 2.2 accessibility guidelines on government web platforms, with the objective of mitigating the risks of exclu-sion and promoting inclusive digital governance in favor of people with disabilities. To this end, a qualitative-documentary approach is used, with a descriptive scope, as it integrates the review of doctrine, international and national regulations. The legal research method is of an interdisciplinary dogmatic type because it examines the topic in question from other disciplines such as law, technology, digital governance, and others. The results reveal that the analyzed government websites partially comply with accessibility criteria, mainly regarding perceptibility (lack of alternative text for images), operability (limited keyboard navigation), and robustness (inconsistent HTML structure). The findings compromise the effective exercise of fundamental rights, such as the right to digital accessibility for people with disabilities. Finally, the study concludes that the Peruvian State, within the framework of adequate digital governance, must adopt urgent and sustained measures to overcome the deficiencies detected in web accessibility. These actions should not be restricted to specific technical solutions but should be integrated into a holistic public policy that harmonizes institutional, regulatory, and technological efforts.
